          <datacite:description descriptionType="Abstract">本研究では，イギリスにおいて「1993年教育法」によって設置された特別な教育的ニーズ裁定委員会（Special Educational Needs Tribunal）に対する親の不服申し立ての内，特に，判定書の第2節（特別な教育的ニーズ）と第3節（特別な教育的対応）に対する申し立てに焦点を当てて，事例の分析に基づいて，その特徴を明らかにすることを目的とした。本研究の結果，①特別な教育的ニーズを持つこと及び特別な教育的対応を与えられることに対して異議を唱えるケースは少ないこと，②特別な教育的対応については適切な施設・設備，教職員の編成，カリキュラムに関する内容が多いこと，③親の希望や意向よりも子どもにとっての教育的利益が優先されること，④言語療法は教育的対応であると裁定が下されること，⑤作業療法や理学療法等の教育当局以外が提供する内容についても教育的対応であると裁定が下される可能性があること，⑥特別な教育的対応は，特定的に，詳細に，量的に記されなければならないという裁定が下される傾向にあること，等が明らかにされた。</datacite:description>
          <datacite:description descriptionType="Abstract">The purpose of this study was to analyze the parental appeals concerning the part 2 (special educational needs) &amp; 3 (special educational provision) of the statements of special educational needs in Great Britain. The main points which were clalified by this study were as follows: 1) parents rarely appealed that their children didn't have special educational needs or that they didn't need special educational provision, 2) the contents of appeals about part 3 were mainly appropriate facilities and equipment, staffing arrangement, and curriculum, 3) the educational interests of children were superior to the parental wishes, 4) Special Educational Needs Tribunal recognized that services provided by non-educational authorities such as speech therapy, occupational therapy, physical thrapy and so on were also special educational provision, and 5) it ordered that special educational provision should normally be specific, detailed and quantified.</datacite:description>
