| 内容記述 | 小論はロックの自然法論を考察する。ロックは自然法の存在証明を経験論的な認識論によって与えている。この態度表明は，心に刻印された良心であるとか生得観念としての神の観念から自然法の存在を証明する途を選ばないという，彼のつよい決意を語っている。ロックの議論においては，神の栄光という最終目的に合わせて，諸般の人間的実践の個別具体の画定作業が行なわれるが，その作業の一環として「人間自身のなりたちと人間的な諸能力の準備状況」が参照されなければならない。しかしこの参照の沃野には，「自然のある種の性向」「内面の教唆」「自己保存」「各人の私的功利」といった強いインパクトのある人間の自然的性向が立ち現れる。ロックもまた「自己保存」が自然法の一部であることを認めるけれども，自然法の第一次的源泉をこうした人間の自然的傾向に求めることはなかった。 | |||||||||||

| 内容記述 | Since Locke wrote his essays in Latin,the language used by most of exponents of the traditional theory of natural law,we have thought it advisable to reread the Latin text as accurately as possible and for us to have an opportunity of learning the Lockean theory of natural law now and again. Our article consists of five parts in partly keeping with the order of the original Latin text.The parts read as follows: １. Introduction; ２.is there a rule of morals,or law of nature given to us?; ３. can the law of nature be known by the light of nature?; ４. is the law of nature inscribed in the minds of men?; ５. can reason attain to the knowledge of natural law through sense-experience? | |||||||||||
