| 内容記述 | 本稿では，イギリスの「1995年障害者差別禁止法」（DDA）及び同法の修正法である「2001年特別な教育的ニーズ・障害法」（SENDA）において，高等教育機関における障害による差別の禁止がいかなるかたちで規定されているのかについて明らかにすることを目的としたものである。DDAは，雇用などについては障害による差別を禁止していたが，教育の分野では同様な規定がなされていなかった。しかし，SENDAにより，高等教育の責任機関が入学申込，入学決定の措置，入学の方法，教育や生活に対するサービスの提供において差別すること，及び障害学生を排除して差別することの違法性が法令上明記されることになった。障害による差別の禁止において重要な概念となるのは，非好意的な処遇を行わないこと及び合理的な調整を行うことの2つである。法令では，この2要件を履行しない場合でも，それが障害による差別に該当しないとされるケースがあることが示されてはいるが，極めて限定的である。DDA及びSENDAの施行により，高等教育機関における障害学生のインクルージョンが進展することが予想される。 | |||||||||||

| 内容記述 | The purpose of this study was to analyze the provisions concerning disability discrimination in the Disability Discrimination Act 1995 (DDA) and the Special Educational Needs and Disability Act 2001 (SENDA) . DDA, which places requirements on employers and service providers not to discriminate against people with disabilities, did not originally include similar requirements for the provision of education. SENDA amended DDA, and the changes by SENDA made it unlawful for institutions to discriminate against disabled students in their admission, admission arrangements or terms, exclusion or suspension arrangements, and the provision of student services. From the implementation of this legislation, responsible bodies are required not to discriminate against people with disabilities. When we consider the discrimination against the students with disabilities, less favourable treatments and reasonable adjustments are very important concepts. It is anticipated that inclusion at universities in UK will be promoted by DDA and SENDA. | |||||||||||
